TERMS OF SERVICE (GTC / TERMS AND CONDITIONS OF USE) – SWISS ACCENT

These Terms of Service (hereinafter the "Terms") apply to any use of the Swiss Accent website and to any order placed via our online store. By placing an order or using the website, you accept these Terms.


1) Seller Information and Contact

2) Scope of Application

These Terms govern:

  • the browsing and use of the website,
  • the sale of products via the online store,
  • the relationship between Swiss Accent and any person placing an order (hereinafter the "Customer").

If any provision is found to be invalid, the remaining provisions shall continue to apply.


3) Products

We describe our products as accurately as possible (photos, descriptions, specifications). However, slight variations (colours, appearance, finishes) may exist depending on screen display or production batches, to the extent permitted by law. Product availability is indicated on the website, subject to stock errors or exceptional unavailability.


4) Prices

Prices are displayed on the website, generally in Swiss francs (CHF), unless otherwise indicated. Shipping costs and any additional charges (e.g. delivery options) are displayed before the final confirmation of the order. Depending on the destination, taxes, customs duties or local charges may apply and remain, unless otherwise stated, the responsibility of the Customer. We reserve the right to modify our prices at any time, but the price charged will be the one displayed at the time of the order.


5) Order

An order is considered confirmed when:

  • the Customer has confirmed their basket and contact details,
  • has accepted these Terms,
  • and has completed payment (or selected an accepted payment method).

After confirmation, a confirmation email may be sent. Swiss Accent reserves the right to refuse or cancel an order, in particular in the event of:

  • a payment dispute,
  • suspected fraud,
  • an incomplete delivery address,
  • an abnormal or abusive order.

6) Payment

Payment is made via the methods available on the store at the time of the order (e.g. bank card, partner payment solutions). Payments are processed by secure providers. As a general rule, we do not retain complete payment data. The order is dispatched after receipt/validation of payment, unless otherwise indicated.


7) Delivery

Deliveries are made to the address provided by the Customer at the time of the order. The delivery timeframes displayed are indicative and may vary depending on the carrier, the destination, peak periods or events beyond our control. Risk is transferred to the Customer at the time the parcel is handed over to the carrier, to the extent permitted by applicable law. In the event of a damaged parcel upon receipt, the Customer should ideally:

  • raise reservations with the carrier if possible,
  • and contact us promptly with photos (see the "Claims" article).

8) Right of Withdrawal and Returns

Swiss Accent grants the Customer a 14-day right of withdrawal from the date of receipt of the order, in accordance with the terms described in our Return and Refund Policy. The conditions, timeframes, exclusions, return address and refund terms are detailed in that policy, which forms an integral part of these Terms.


9) Claims (Defective, Damaged or Incorrectly Prepared Items)

In the event of a defective product, a product damaged upon receipt, or an error in order preparation, the Customer must contact us as soon as possible and no later than 7 days after receipt, at: info@swissaccent.ch

Please provide:

  • the order number,
  • a description of the issue,
  • clear photographs (item, packaging, label if necessary).

We will offer an appropriate solution (replacement, exchange, refund, etc.) depending on the situation and to the extent permitted by law.


10) Warranties

The Customer's rights under applicable statutory warranties (in particular in the event of a defect) are reserved, within the limits provided for by Swiss law. Any claim relating to a defect must be reported as soon as it is identified, in order to allow prompt handling.


11) Retention of Title

Delivered products remain the property of Swiss Accent until full payment of the price has been received.


12) Use of the Website

The Customer agrees to use the website in accordance with the law and these Terms, and in particular not to:

  • disrupt the operation of the website,
  • attempt to access unauthorised areas,
  • use the website for fraudulent purposes.

We may suspend or restrict access to the website in the event of abuse, to the extent permitted by law.


13) Intellectual Property

The content of the website (texts, visuals, photos, logos, design, etc.) is protected. Any reproduction, modification, distribution or exploitation without prior authorisation is prohibited, except as permitted by law.


14) Data Protection

The processing of personal data is described in our Privacy Policy. By using the website or placing an order, the Customer acknowledges having taken note of it.


15) Liability

To the extent permitted by applicable law, Swiss Accent shall not be held liable for:

  • indirect damages (loss of profit, loss of data, etc.),
  • delays or failures due to events beyond our control (see Article 16),
  • improper use of the products by the Customer.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.


16) Force Majeure

We shall not be held liable for any delay or failure to perform due to a force majeure event or equivalent (e.g. natural disaster, strike, transport disruption, network outage, decision by the authorities, etc.).


17) Amendments to the Terms

We may amend these Terms at any time. The applicable version is the one in force at the time of the order. The date of the last update appears at the top of this document.


18) Applicable Law and Jurisdiction

These Terms are governed by Swiss law. Subject to any applicable mandatory rules, any dispute shall be submitted to the competent courts of the Canton of Geneva, Switzerland.
